Certain violent and sexual offenses are ineligible for vacation. 6 CMC § 4113(m).
Procedure General
Upon successful completion of the probation period, the Office of Adult Probation shall file a motion to set aside conviction within 30 days of the end of the probation period. The prosecutor has 20 days to object. For the specific procedure, see 6 CMC § 4113(k).
Fees
All court-ordered fees must be paid. 6 CMC § 4113.
Effect
The conviction is deemed not to exist.
