Records relating to arrests and charges are extracted from police department files when three years have passed since an arrest without conviction and there are no pending proceedings. 18 Pa. Cons. Stat. § 9121(b)(2)(i).

Procedure General
The procedure is automatic. Before a police department disseminates criminal history record information to an individual or noncriminal justice agency, it extracts from the record all notations of arrests, indictments, or other information relating to the initiation of criminal proceedings. 18 Pa. Cons. Stat. § 9121(b)(2)(i).
