The policy applies to Class B or C misdemeanor traffic convictions only.
Procedure General
The process for the automatic expungement shall be in accordance with any rules made by the Judicial Council or the Supreme Court. Records may be expunged after five years for a class C misdemeanor or an infraction, and at least six years for a class B misdemeanor. Utah Code Ann. § 77-40a-202.
Fees
There is no statutory language regarding fees.
Effect
Records for the traffic offenses shall be deleted without a court order or notice to the prosecuting agency. Utah Code Ann. § 77-40a-202.
